Avon Park’s 1925 36-section boundary expansion was invalidated in 1933

In 1925, the Florida Legislature passed a special act that expanded the City of Avon Park from 1,440 acres to a massive 23,040 acres, encompassing thirty-six sections (the entirety of Township 33 South, Range 28 East). This effectively annexed surrounding pasture and groves into the municipality at a ratio of approximately twenty-three new acres to every original acre.

The Florida Supreme Court invalidated this special act in 1933 in the quo warranto proceeding State ex rel. Attorney Gen. v. City of Avon Park, 108 Fla. 641, 149 So. 409 (1933).[fla-108-641] The Court found that the drastic alteration of municipal boundaries lacked sufficient connection to the city’s actual needs or the interests of the affected areas.

This judgment explains why lands like the Lake Lotela Garden Subdivision, which were formally within the boom-time city limits when platted, were legally outside the corporate limits by 1943.
